DUI’s are like Snowflakes


DUI’s are like snowflakes, no two are exactly alike. And they can be complicated from a legal defense standpoint.

Here, I want to say two basic things about DUI’s. One, never do the roadside field sobriety tests, tests like the eye test, the walk and turn test, the one leg stand test, the alphabet test, the counting test, and the finger dexterity test.  One client aptly called them “roadside Olympics”. You are not legally required to take these tests, but the police officer will never tell you this.

Two, unless you simply do not want to go to jury trial, there is really no good reason legally to plead guilty to a first or even a second offense DUI. If you have a lawyer who is advising you to plead guilty, you may want to obtain a second opinion.
